These terms apply to video walkthrough services provided by Property Motion Media (“Provider”) to a client (“Client”), whether ordered through this website, through a payment link, or under a separate signed services agreement.
The short version. Every video is built from the property’s real photographs. We do not add, remove, or alter anything about the property, and every delivery says so on screen. To build the video we upload your property photos to third-party AI generation platforms, which is explained in full in section 3 — please read it before you order.
Provider will create cinematic video walkthrough(s) generated from the property’s existing photographs supplied by Client or from Client’s public listing. Deliverables per the selected package may include a vertical (9:16) social cut, a widescreen (16:9) listing cut, licensed music, on-screen captions, and Client branding.
Provider creates the video using one or more third-party AI video generation platforms. To do this, Provider uploads the property photographs Client supplies, or that appear in Client’s public listing, to those platforms. Provider will identify the platforms currently in use on request.
These platforms operate under their own terms of service, which Provider cannot alter or negotiate. Those terms commonly grant the platform a broad, worldwide, perpetual license to use uploaded material and generated output, including to train and improve their AI models and to promote their own services, and commonly disclaim responsibility for how uploaded material is used. Provider has no control over this and cannot promise that a platform will delete, un-train, or cease using material once it has been uploaded.
Provider uploads only the property photographs needed to produce the deliverable. Provider does not upload Client’s contact records, client lists, transaction documents, or any personal information concerning Client or Client’s customers. Provider does not upload photographs of identifiable people.
If Client cannot or does not wish to have the property photographs uploaded on these terms — for example because Client’s agreement with the photographer or brokerage does not permit it — Client should say so before work begins, and Provider will not proceed with that listing.
Per-listing packages are due 50% on booking and 50% on delivery, unless otherwise agreed. Retainers are billed monthly in advance. Payment methods and instructions appear on the invoice.
The Listing Package includes one round of revisions (music, captions, pacing, or regeneration of individual room clips). Additional revision rounds are billed at a rate agreed in advance.
Upon full payment, Client receives a perpetual license to use the delivered videos for marketing the listed property and Client’s own brand, on any platform. Provider retains the right to display delivered work in Provider’s portfolio and social channels unless Client opts out in writing.
Client confirms it owns the supplied photographs or holds a license broad enough to permit both the marketing use of them and their upload to third-party AI generation platforms as described in section 3, and that information provided about the property is accurate. Client is responsible for compliance with brokerage policies applicable to Client.
Provider’s total liability under this agreement is limited to the amount paid by Client for the deliverable at issue. Provider is not liable for indirect or consequential damages. This agreement is governed by the laws of the state of California.
Client accepts these terms by checking the agreement box at checkout, or by signing a Property Motion Media services agreement. Retainers and larger engagements use a countersigned agreement that incorporates these terms. Questions before you order are welcome — hello@propertymotionmedia.com.
